Terms of Service

To access certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

• In any way that violates any applicable federal, state, local, or international law or regulation
• To generate content that is defamatory, obscene, harmful to minors, or promotes violence or discrimination
• To infringe upon or violate the intellectual property rights or other rights of any third party
• To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service
• To use any robot, spider, or other automatic device, process, or means to access the Service for any purpose

The Service and its original content, features, and functionality are and will remain the exclusive property of True Brain Labs and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

You retain ownership of the content you upload to the Service. By uploading content, you grant us a license to use, reproduce, modify, and display that content solely for the purpose of providing and improving the Service.

Content generated using our AI tools is subject to the license terms specified in your subscription agreement. Generally, you own the outputs you generate, subject to our underlying rights in the Service and any third-party content incorporated in your outputs.

Certain features of the Service require payment. By selecting a paid subscription, you agree to pay all fees associated with your selected plan. All fees are non-refundable except as required by law or as explicitly stated in these Terms.

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period.

We reserve the right to change our pricing at any time. We will provide advance notice of any material price changes before they take effect.

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or delete your account through your account settings.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

In no event shall True Brain Labs, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

Our total liability to you for all claims arising from or relating to these Terms or your use of the Service shall not exceed the amount you paid to us, if any, during the twelve (12) months immediately preceding the event giving rise to the liability.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the federal or state courts located in San Francisco County, California.
